I trust you are well.

 

I remember discussing this matter with your good self and Mrs Virgo some weeks ago and I was under the impression that the hours requested were ok.

 

I have attached a copy of the statutory notice that had been displayed outside the premises as a reminder.

 

Standard hours requested for licensing activities i.e. alcohol for consumption on the premises only as LNR is not required because the premises will normally close at 23.00 hours on all days during the year except for Sundays (closing at 22:30 hours)  are detailed below under standard days.

 

However we wish for four exceptions – i.e. for Xmas eve evening, Xmas day evening, Boxing day evening & New year’s eve evening .  LNR and alcohol sales for consumption on the premises are both required for these four evenings:

 

Standard days (361 days a year)

 

11.00 to 23.00 hours Monday to Saturday

11.00 to 22.30 hours Sunday

 

For the four days highlighted above during the Xmas and New Year’s period - the hours requested are:

 

11.00 to 24.00 hours irrespective of the day in the week any of the four days falls upon (therefore should any of the four days listed above fall upon a Sunday then the licensable activity of LNR [from 23.00 hours – therefore one hour extra] and alcohol for consumption off the premises is increased by an hour and a half rather than an extra hour should the seasonal day fall Monday to Saturday. In all cases the terminal hour is still midnight ON THOSE FOUR DAYS ONLY and NO licensable activities are sought after midnight.

Residents seem to think that you seek LNR & alcohol supply during non-standard times on Sundays up to 12.30am. Please confirm if this misconception have been clarified with residents and if so do they maintain their representation?

 

For avoidance of doubt, please confirm, in writing, the hours being sought especially on Sundays. Following this, I will be in a position to withdraw my representation.

Many thanks for your helpful suggestions re the above premises licence application.

 

I have consulted with my client and can therefore agree we accept all six conditions as worded in your note dated 19th June 2019.

 

I have also copied in Mrs Virgo of the Paddington Waterway & Maida Vale Society for her kind information as we have had previous correspondence regarding concern over the potential numbers of smokers from the restaurant permitted outside late at night. I trust and hope this condition (and others as per the attachment) may allay the Society’s fear regarding this issue and if so perhaps Mrs Virgo would write to the Licensing department cc myself and confirm same.

I have just been informed we have been listed for a hearing.

 

Please see the correspondence below with Mrs Virgo of the Paddington, Waterway & Maida Vale society. I think she is awaiting a response from you regarding a reasonable number of people smoking outside a restaurant.

 

I have also yet to receive your latest thoughts following your site visit the week before last.

 

Obviously I am attempting reconciliation to assist the client with seeking agreement with the bodies making reps.

 

We will have to instruct advocates very soon to represent the client at the hearing on the 4th July should we not hear from either organisation. This is obviously a cost to the client.

 

I would therefore be grateful for your thoughts and sight of your email response to Mrs Virgo who strikes me as an experienced and reasonable person.

 

Michelle also asked for a word copy of all conditions offered to date.

Thanks for your prompt response. Re the concern over numbers of patrons smoking outside at any one time – I would comment that many people today do not smoke and numbers appear to be falling also the capacity of the restaurant is quite modest at  55 covers. It is therefore reasonable to assume that the number of diners outside at any one time is going to be very small although in vertical drinking establishments (which the applicant premises are not) numbers could be higher..

I think that there will probably be a limit put on the number of smokers who can congregate outside at any one time which will be raised by Environmental Health or whatever it calls itself in these changeable days. I would like to see that first.

May I thank you for getting in touch with me yesterday regarding my clients new premises licence application and for taking the time to outline the potential concerns local residents may experience.

 

I think from our discussions you are, shall I say less unhappy, with regard to the requested additional trading times on Xmas eve, Xmas day, New Years eve & New years day until midnight and are therefore dare I say are prepared to drop that specific objection.

 

However I do understand your concerns regarding the second specific point you raise in your representation and as you put it to me – your main issue with regard to patrons of the restaurant potentially bringing alcohol purchased in the restaurant to consume outside the premises whilst having a cigarette.

 

May I offer the following wording for your kind consideration:

 

 

Should this wording  allay your concerns may I respectfully request you drop an email to the Licensing department cc me, confirming your intention to withdraw your representation subject to the inclusion of this condition.

I received an email late last week from Westminster Licensing which included an attachment detailing a representation against my clients application by yourself on behalf of WMV.

 

The current position is that unless an agreement is reached between the parties this matter is to be referred to the Westminster Licensing sub-committee on the 4th July for a hearing.
